1.免責聲明、約束性協議與附加條款及協議。
1.1 免責聲明。本軟體及其他資訊乃依「現況」提供，不保證毫無錯誤。對於貴使用戶藉使用本軟體或第三方產品所獲得之效能或結果，手機醫生不提供亦無法提供任何保證。除了貴使用戶所在管轄地之適用法律不准許加以限制或排除之任何保證、條件、陳述或條款以外，手機醫生就任何事宜，包括但不限於不侵害第三方權利、適售性、完整性、品質滿意度或任何特定用途之適用性，不論依成文法、普通法、慣例、使用常規或其他規範，概不作出任何明示或默示之保證條件、陳述或條款。若本協議不論因何故終止，第1.1節在本協議終止後依然有效，但並不默示或准許使用者得在本協議終止後繼續使用本軟體。
1.2 約束性協議：手機醫生軟體之全部或任何部分一經使用，即視為貴使用戶接受本協議之全部條款。在接受本協議之後，本協議效力及於貴使用戶和任何其他取得本軟體之實體及代表其使用本軟體之人士。如貴使用戶不同意此條件，請勿使用本軟體。

2. 定義。
本協議所稱之「手機醫生」係指位於中華民國之公司組織點子行動科技股份有限公司。
「裝置」係指行動裝置、手持電話、PDA或其他相類似的網路應用產品或網路連接裝置。
「軟體」係指(a)本協議所涵蓋之檔案（提供電子下載）或其他媒體之全部內容，可能包括︰(i)手機醫生軟體；(ii)相關之書面解釋內容或檔案（「說明文件」）；以及(b)手機醫生不定時對貴使用戶提供之升級版本、修正版本、更新、功能增強以及前述各項目之副本（以下統稱為「更新」）。
「使用」係指存取、安裝、下載、複製或透過利用本軟體之功能獲得其他益處。

3. 軟體授權。
如貴使用戶自App Store/Google Play 付費並取得本軟體，並遵守本協議之條款，包含第4節所述之限制。
3.1 一般用途。貴使用戶可在相容的裝置上安裝及使用本軟體。有關使用本軟體的重要限制，請參閱第4節。
3.2 分發。本授權並未授予貴使用戶轉授權或分發軟體之權利。


4. 義務與限制。
4.1 聲明。貴使用戶不得修改或移除本軟體上和本軟體中出現的任何著作權和其他所有權聲明。
4.2 不得修改或進行逆向工程。貴使用戶不得修改、變更、翻譯本軟體或自本軟體改作出衍生著作。貴使用戶不得就本軟體進行逆向工程、反編譯、反彙編或以其他方式試圖探究本軟體之原始碼。

5.智慧財產所有權，保留權利。
本軟體屬手機醫生的智慧財產。本軟體之結構、組織及程式碼為手機醫生之有價智慧財產（如商業機密及保密資料）。本軟體受法律保護，包括（但不限於）美國及其他國家之著作權法，本軟體亦受國際條約協定保護。除非本協議明文規定，否則本協議不授予貴使用戶本軟體之任何智慧產權，此外手機醫生保留未明確授予之其他全部權利。

6. 連接性及隱私權。貴使用戶承認並同意下述條款：
6.1 檢測結果之使用。當貴使用戶以本軟體開啟已啟用本軟體之手機檢測功能時，貴使用戶之裝置可能會連接至由手機醫生所營運之網站。此時，本軟體會傳送貴使用戶的手機檢測結果及硬體相關資訊。代管網站方可能使用相關技術來傳送（或稱「伺服」）出現在已完成的檢測結果或其他電子內容。
6.2 手機醫生不會傳送任何用戶個人隱私資訊。

7. 責任限制。
無論在任何情況下，手機醫生不負責賠償貴使用戶的任何損害、損害賠償或相關開銷，包括任何衍生、間接、附帶的損害或利潤或盈餘損失，即使手機醫生之代表已事先得知可能發生此類損失、損害或損害賠償亦同。於貴使用戶所在管轄地的法律許可範圍內，前述限制及排除條款一律適用。手機醫生按本協議規定所應承擔的累計賠償總額，應以本軟體的購買價格（新台幣30元；免費下載者不賠償）為上限。本協議所述內容不得限制手機醫生因怠忽或詐欺造成人員傷亡所應負之責任。

8. 準據法。
本協議應以現行實體法為執行與釋義之準據：以本公司所在地為司法轄區，並以中華民國之法律為準據法。若對本協議內容有任何爭議，應以高雄地方法院為初審法院。本協議不受任何管轄地之法律抵觸原則或《聯合國國際商品買賣契約公約》(United Nations Convention on Contracts for the International Sale of Goods)約束，故本協議明文排除該公約之適用。

9. 一般條款。
本協議之任何條文如經認定為無效或無執行效力，並不影響其餘條款內容的效力和執行力。本協議不會妨礙任何當事人以消費者身份應享有之法定權利。本協議之修訂需以書面為之並經手機醫生授權之主管簽名後始具效力。手機醫生可按追加或經修改之條款對使用者授權更新版本。本協議構成手機醫生與使用者之間就本軟體相關事宜所為之全部協議，並取代雙方先前就本軟體相關事宜所為之一切申述、討論、承諾、溝通、或廣告。
